Terms of Service

These Terms of Service ("Terms") govern your use of ZipLock, operated by That's Smart LLC ("Company," "we," "us," "our"). By accessing or using our website (ziplock.app), SMS service, or any related features, you agree to these Terms. If you do not agree, do not use ZipLock.

1. Service Description

ZipLock is a property owner intelligence platform for real estate professionals. The service provides verified property owner contact information, AI-powered market analysis, email drip campaigns, seller lead scoring, and related tools. Data is delivered via SMS text messaging, web dashboard, and email.

2. SMS/Text Messaging Terms

By opting in to ZipLock's SMS service, you agree to the following:

  • Program name: ZipLock Property Lookup
  • How to opt in: Create an account at ziplock.app and verify your phone number, or text START to (614) 548-9889
  • Message types: Property owner lookup results, AI-generated talking points, lead alerts, account notifications, search balance alerts, and service updates
  • Message frequency: Varies based on your usage. Each address you text generates a response. Lead alerts may be sent daily. You control frequency through your usage.
  • How to opt out: Text STOP to (614) 548-9889 at any time. You will receive a confirmation message and no further texts will be sent.
  • Help: Text HELP to (614) 548-9889 for support, or email support@ziplock.app
  • Message and data rates: Standard message and data rates from your wireless carrier may apply
  • Carrier support: Service is available on most major US carriers including AT&T, Verizon, T-Mobile, and Sprint. Service may not be available on all carriers.

Your consent to receive SMS messages is not a condition of purchasing any goods or services. We will not share your phone number or SMS opt-in data with any third parties for their marketing purposes.

3. Account Registration

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 18 years old and legally able to enter into a binding agreement to use ZipLock.

4. Acceptable Use

You agree to use ZipLock and all data obtained through the service only for lawful purposes. You must not:

  • Violate the Telephone Consumer Protection Act (TCPA) or any state telemarketing laws
  • Violate the Fair Housing Act or engage in housing discrimination
  • Use data for harassment, stalking, intimidation, or threats
  • Use data for identity theft, fraud, or impersonation
  • Resell, redistribute, or sublicense ZipLock data to third parties
  • Scrape, bulk download, or systematically extract data from the service
  • Use automated tools or bots to access the service beyond its intended use
  • Circumvent rate limits, usage caps, or access controls
  • Use data in any manner prohibited by applicable federal, state, or local law

You are solely responsible for your compliance with all applicable laws when contacting property owners using data obtained through ZipLock, including but not limited to the TCPA, state Do Not Call regulations, and CAN-SPAM Act.

5. Data Accuracy Disclaimer

Property data is sourced from public records and third-party data providers. While we use AI verification across 500+ data points, ZipLock makes no guarantees about the accuracy, completeness, timeliness, or reliability of any data provided. Owner names, phone numbers, email addresses, property valuations, and other information may be incorrect, outdated, or incomplete.

Users must independently verify all information before taking any action. ZipLock is not a consumer reporting agency and does not provide consumer reports as defined by the Fair Credit Reporting Act (FCRA). Data from ZipLock must not be used for credit decisions, tenant screening, insurance underwriting, or employment purposes.

6. Searches, Billing, and Subscriptions

  • Searches are non-refundable and non-transferable
  • Unused searches expire at the end of each billing cycle and do not roll over
  • Top-up searches are added to your current balance and expire at the end of the billing cycle in which they were purchased
  • Subscription plans renew automatically unless cancelled before the renewal date
  • You may cancel your subscription at any time through the dashboard settings or by contacting support@ziplock.app
  • No pro-rated refunds are provided for mid-cycle cancellations
  • All payments are processed securely by Stripe. We do not store credit card numbers.

7. Zip Code Availability

Zip code availability is subject to a revenue cap per zip code to maintain data quality and value for subscribers. ZipLock does not guarantee exclusive access to any zip code. We reserve the right to modify revenue caps, adjust the number of available slots, and open or close zip codes at any time without prior notice.

8. Email Campaigns

ZipLock provides email drip campaign tools for reaching property owners. You are solely responsible for ensuring your use of these tools complies with the CAN-SPAM Act and all applicable email marketing laws. All emails sent through ZipLock include an unsubscribe mechanism. You must not use ZipLock's email tools to send spam, misleading content, or messages to recipients who have opted out.

9. Intellectual Property

ZipLock, its logo, design, features, and technology are owned by That's Smart LLC. You may not copy, modify, distribute, or reverse engineer any part of the service. Property data accessed through ZipLock is licensed for your personal or business use only and may not be resold or redistributed.

10. Termination

We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any conduct that we determine is harmful to other users, us, or third parties. Upon termination, your zip code slots will be released and no refund will be provided for the current billing period. You may terminate your account at any time by contacting support@ziplock.app.

11. Limitation of Liability

ZipLock is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall That's Smart LLC, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the service, including but not limited to loss of profits, data, business opportunities, or goodwill, even if advised of the possibility of such damages.

Our total liability for any claim related to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless That's Smart LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law

These Terms are governed by the laws of the State of Ohio without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Franklin County, Ohio.

14. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or through the service. Continued use of ZipLock after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the service and close your account.
